Judge halts payment of Mabuza's R44m pension
Alexander Forbes has been interdicted from paying former Deputy President David Mabuza’s R44.7m pension to his widow, Patience Mnisi.
Acting Judge Johannes Roelofse yesterday granted the interdict in the Mpumalanga High Court, reports News24.
This after Tamara Silinda, Mabuza’s daughter from another woman who claimed to have been his customary wife, took the matter to court to fight for her share of the pension.
The matter was complicated by Tamara’s mother’s marital recognition claim.
Roelofse said he was not convinced that the R44.7m would not be lost if it were transferred to Mnisi.
He added: ‘I still have doubts in my mind that the applicant has the right to demand the money, but that does not stop me from granting an interim order.’
Meanwhile, the judgment was scathing of Alexander Forbes.
Roelofse said the financial institution had acted like ‘Pontius Pilate’ and washed its hands of the matter.
Alexander Forbes was ordered to pay for last week’s court proceedings, and all parties were instructed to approach the court before 15 October about the part of the application that deals with the management of the pension fund.
