Nicholas Veltman deals principally with issues relating to mining law, and construction and engineering. He has been involved in a number of health and safety investigations and has conducted various due diligence exercises for clients focusing on compliance with mining and related legislation. In terms of the Mine Health and Safety Act and the Occupational Health and Safety Act, Nicholas has assisted and represented various mining houses and construction companies at investigations and inquiries conducted by the relevant authorities. His experience extends to commercial litigation and arbitrations, as well as general corporate and commercial work. More recently, Nicholas has become involved in renewable energy power projects and construction contracts including standard form FIDIC, bespoke construction and EPC contracts. He has acted for a number of companies in Department of Energy's IPP Procurement Programme transactions: Windfall 59 Properties (RF in respect of the engineering, procurement and construction, and operation and maintenance of a 74MW photovoltaic facility. Blue Falcon 140 Trading (RF) in respect of the engineering, procurement and construction, and operation and maintenance of a 135.5 MW wind power generation facility.  Representative experience: Representing mining and construction companies at the Departments of Mineral Resources or Labour investigations and inquiries in terms of health and safety legislation. Successfully assisting clients with section 54 instructions to halt mining operations, and instructions in terms of section 55 of the Mine Health and Safety Act. Assisting clients in making representations to the Department of Mineral Resources in respect of administrative fines, and the review and setting aside of these fines. Assisting and representing various mining houses and construction companies at criminal trials in relation to MHSA and OHSA matters. Assisting clients with internal appeals in connection with mining and prospecting rights in terms of section 96 of the MPRDA up to the High Court. Advising clients on regulatory matters in terms of the MPRDA, including mining rights, prospecting rights, and transfer and amendments of rights applications. Advising clients on operational related agreements, including mining EPC agreements, contract mining agreements, drill and blasting agreements, and supply agreements. Providing mining related advice (in terms of the MHSA and MPRDA) to business rescue practitioners, mining clients in business rescue or their creditors.
