DA to argue Myeni re-appointment is 'irrational'
The DA's planned legal action against the Cabinet decision to re-appoint Dudu Myeni as SAA chair will be based on the argument that it was ‘wholly irrational’, notes a BDlive report. DA leader Mmusi Maimane said yesterday the party was of the ‘strong opinion that there is prima facie case to be made that Ms Myeni's re-appointment is wholly irrational, given her appalling performance as SAA board chairperson over the past four years ... overseeing the airline’s steady decline’.
An application would be made in the Western Cape High Court in the next few days to have the re-appointment decision set aside. He said the DA had succeeded previously in getting the judiciary to review an appointment, when it challenged the appointment of Menzi Simelane as National Director of Public Prosecutions on the grounds of irrationality.
Myeni has a long record of financial mismanagement, extending from even before she was first appointed to the position at the SAA, the DA revealed. According to a Fin24 report, the party’s federal executive chairperson James Selfe said Myeni failed to adequately perform her tasks as the chairperson of the Mhlathuze Water Board.
Other ‘shocking elements’ of her record included:
* A failed probity test, which showed a default judgment against her in relation to R416 460 owed to Absa bank.
* A R1.7m judgment in favour of Standard Bank with regard to a property she reportedly co-owns.
* A Special Investigating Unit probe into alleged maladministration and abuse of state resources, unfair dismissal of staff and non-compliance with tender processes when she was chair of the Mhlatuze Water Board.
Selfe labelled the appointment ‘a deliberate act of cadre deployment and nepotism’.
