White farmer to get R15m for forced sale
Following the latest ruling by the SCA, the way has been paved for former Eastern Cape farmer Ivor Phillips (82) to be awarded almost R15m for land he was forced to sell as part of the apartheid government’s doomed homeland scheme, says a Daily Dispatch report.
The payout figure excludes interest and legal costs which also could run into millions of rands. In the past years, a number of court decisions have gone the way of Phillips. However, each time the state lodged appeals and lost all of them in the Land Claims Court.
According to court papers, the government initially made an offer of R6.9m for settlement in 2008, but withdrew and disputed the claim on the grounds – among other things – that Phillips was white. However, the SCA has now found that there was no reasonable prospect of another court finding the Lands Claims Court had erred in its earlier determination.
