Fight over language policy taken to higher courts
Lobby group Gelyke Kanse (Equal Opportunities) is heading for the SCA and may also launch a direct application to the Constitutional Court following its defeat in the High Court. A report in Die Burger notes that Gelyke Kanse wants the court to set aside Stellenbosch University’s language policy stipulating English as the primary language of instruction.
It argues that the new policy was adopted in terms of an irrational process, but the Western Cape High Court rejected the argument and issued a costs order against Gelyke Kanse. The group’s Philip Spies says it believed the judgment was erroneous in several respects. ‘Among other things, the court refused to accept the affidavits of several registered students in which they complained about the policy.’
