The state capture about-turn by police and the NPA – evident since the ousting of President Jacob Zuma – will be given impetus today when Zuma's son Duduzane appears in the Specialised Commercial Crime Court over his alleged involvement in the Gupta plot to bribe former Deputy Finance Minister Mcebisi Jonas, notes Legalbrief.

At a meeting with Duduzane, businessman Fana Hlongwane and older Gupta brother Ajay, Jonas was allegedly offered the position of Finance Minister as well as a bribe of R600m. It is understood he will be charged with contravening the Prevention and Combating of Corrupt Activities Act. A Sunday Times report quotes Duduzane's lawyer, Rudi Krause, as saying he had assured the Hawks that Duduzane would present himself at court, and it would not be necessary to arrest him. Mike Hellens SC, the advocate who has acted for the Guptas and had been expected to represent Duduzane, said he had declined in order to avoid claims of a conflict of interest because he had previously acted for Jonas.

The former President is understood to have been concerned that his son would be arrested or charged if he came home, and advised him against attending the weekend funeral for his brother Vusi (25).

Insiders reportedly told the Sunday Times the charges against Duduzane would be the realisation of his father’s ‘worst nightmare’.

Law enforcement authorities are also understood to be considering charging Duduzane in connection with the Estina dairy project, in which Gupta companies are accused of fraudulently receiving millions of rands intended for poor black farmers in the Free State.

He is a director of Westdawn Investments, one of the Gupta companies that allegedly siphoned off money from the farm project.

The former President’s son was flagged when he arrived from Dubai on Thursday. He was questioned for three hours and avoided arrest at OR Tambo International Airport. But, says a Weekend Argus report, police top brass and intelligence are working closely to ensnare him and an existing warrant of arrest was due to be executed on a case of corruption related to state capture.

‘The matter is related to the statement made by Mcebisi Jonas to the Public Protector,’ a source is quoted as saying.

‘There was a warrant of arrest that was issued and it’s going to be executed on Monday. There is strong evidence against him.’ Jonas, who was the Deputy Minister of Finance, told former Public Protector Thuli Madonsela that he was allegedly offered a R600m bribe for the job of Finance Minister. The meeting is said to have taken place at least a month before then Finance Minister Nhlanhla Nene was sacked in December 2015.

After turning down the offer, the job was given to Des van Rooyen who held the position for a weekend. The financial markets tumbled and he was replaced by Pravin Gordhan. Jonas provided Madonsela with SMSes in which Duduzane requested a meeting with him. Hawks spokesperson Brigadier Hangwani Mulaudzi would neither confirm nor deny the imminent arrest. ‘I will be speaking to the media on Monday,’ he said. ‘This is a very sensitive issue. Duduzane must be given a chance to mourn. We will talk about this on Monday.’

Duduzane was not supposed to have been in the dock alone, notes a City Press report. Accused number 1 was going to be Ajay Gupta, who allegedly made the bribe offer to Jonas, but he remains at large, Hawks sources reportedly told the newspaper. It says prosecutors were working feverishly at the weekend to finalise the charge sheet ahead of today’s appearance. City Press says the case has been further bolstered by a statement obtained from Hlongwane. The prosecution also obtained CCTV footage which they subpoenaed from the Hyatt Hotel in Rosebank, Johannesburg. It shows that Duduzane, Hlongwane and Jonas first met there before proceeding to the Gupta mansion, corroborating what Jonas stated in his affidavit. The source said that prosecutors will not oppose bail, provided that Duduzane surrenders his passport and that strict bail conditions are put in place in exchange for his release.

Duduzane is also facing culpable homicide charges relating to a 2014 car crash – and is due in the Randburg Magistrate’s Court on Thursday. However, it is understood that the case will be postponed, notes News24. Earlier this month, Zuma received a summons to appear in the Randburg Magistrate's Court on 12 July. The summons relate to a February 2014 car crash in which he rear-ended a taxi after losing control of his Porsche on the Grayston Drive off-ramp on the M1, north of Johannesburg. Phumzile Dube was killed instantly and three others were injured. Another passenger died in hospital later, but her death was believed to be linked to natural causes.
