Widow's customary marriage victory in SCA
Lerato Sengadi has dedicated her SCA victory to the millions of black women ‘who couldn't fight back’, says a TimesLIVE report.
The well-known publicist has been locked in a two-year legal dispute with the family of her late husband Jabulani ‘HHP’ Tsambo over her status as the rapper's customary wife.
The SCA dismissed an appeal by HHP's father, Robert Tsambo, against the 2018 Gauteng High Court (Pretoria) ruling that Lerato and Jabulani were married by customary law.
Lerato's status as HHP's wife was challenged by the Tsambo family after the rapper's death in 2018.
The SCA found the respondent and the deceased concluded a customary marriage that complied with all the requirements for a valid customary marriage as contemplated in s 3(1) of the Recognition of Customary Marriages Act.
