The management association of a business estate, which suffered billions of rand in losses during July’s looting and unrest, has secured a High Court interdict against a business forum that allegedly made threats and demanded a stake in the rebuilding process.

The Mercury reports the application by the Cornubia Industrial Business Estate Management Association and company Samuels Group – based at the estate – came before the KZN High Court (Durban) on Wednesday.

It granted an order interdicting and restraining the Amabhubesi Business Forum and the forum’s Thulani Mbanga Nhleyama from assaulting, intimidating, threatening, burning or in any way damaging the property of the estate and the company.

They are further interdicted from threatening, assaulting or intimidating the staff.

The estate association and the company – represented by Nic Kinsley of Larson Falconer Hassan Parsee Attorneys – had also sought a mandatory interdict against the Minister of Police and SAPS eThekwini District detectives to compel them to complete their investigation into the criminal case opened in the matter and to ensure that the estate was protected from violence, looting and theft.

However, the court did not grant this relief as it found that a case had not been made for a mandatory interdict.
