School gets interdict after stabbing row
Selborne College in East London is taking on Education Department head Dr Naledi Mbude in court after she refused to implement a recommendation that the school be allowed to directly expel two grade 10 pupils who stabbed another pupil.
A Daily Dispatch report says the school governing body has had to resort to the Eastern Cape High Court (Makhanda) to interdict the return to school of the two teenage boys after the Education Department threatened the school principal with disciplinary action and suspension if he did not allow them back on campus.
In interdicting the boys’ return to campus, Judge Gerald Bloem ordered that the School Governing Body (SGB) institute its review application by 21 February.
He also ordered that in the meantime the boys remain on as pupils of Selborne College online learning platform only.
Court papers suggest the department went to extraordinary lengths to ensure the two pupils were allowed to return to the school – despite causing serious injury to another pupil.
The SGB did not want the boys back on campus until it had the opportunity to take Mbude’s ‘irrational and unreasonable’ decision on review and have now successfully sought an interdict to prevent their return to campus pending that review.
