Van Loggerenberg flags Shivambu over secret report
Former SARS senior manager Johann van Loggerenberg has lodged a complaint against EFF deputy president Floyd Shivambu with the Registrar of Parliament over his possession of a top-secret report in late 2018.
According to a Business Day report, Van Loggerenberg said his complaint was based on testimony before the Section 194 inquiry into Public Protector Advocate Busisiwe Mkhwebane’s fitness to hold office.
‘I submitted my complaint as (a) layperson as I cannot afford legal assistance in this regard,’ he told Parliament’s Registrar.
Two weeks ago, a manager in the office of the Public Protector told the committee Shivambu gave her the Inspector-General of Intelligence report in 2018.
The report investigated, among other matters, the high-risk investigations unit at SARS, which was led by Van Loggerenberg and became known as the so-called ‘rogue’ unit.
The report, signed by the late Inspector-General of Intelligence Faith Radebe, was produced in 2014.
Six years later, it was annulled in the High Court.
Ponatshego Mogaladi, a former executive manager of investigations in the Public Protector’s office, said she stood in for Mkhwebane during a meeting with Shivambu in December 2018.
Shivambu had by then lodged the complaint about the unit that led to Mkhwebane’s probe.
Van Loggerenberg claimed Shivambu was in unlawful and illegal possession of the report when he met Mogaladi and forwarded the document to her in December 2018.
Said Van Loggerenberg: ‘That document caused untold harm to people and institutions.’
According to the code of conduct of parliamentarians, the Registrar must notify Shivambu of the complaint within seven days and alert him to the consequences should he ignore it.
