Royal AM founder and businesswoman Shauwn Mkhize could lose a fleet of luxury cars because she owes SARS more than R37m in unpaid taxes.

City Press has seen an execution application by the revenue collector at the KZN High Court (Pietermaritzburg) on 9 May, seeking to attach 13 vehicles including a Lamborghini and a Rolls Royce owned by Shandi Trust and Royal AM, the entities in which she is the major shareholder.

SARS says the amount it is trying to recoup is R37 915 549.

It wants to dispose of all the assets owned by the entity and place the cars on auction to recover outstanding taxes.

SARS also wants the cost of the suit to befall Shandi Trust, with the trustees cited as Siphokazi Zuma, Senzekile Mseleku and Melusi Mkhize.

The papers read: ‘Within seven days of granting of this order, all motor vehicles belonging to the Shandi Trust must be delivered to the curator (SARS).

Pending such delivery, such motor vehicles may be used by the person presently entitled to use such a vehicle, provided that, before any such use, the curator be satisfied by presentation to him of such proof as he may reasonably require that the vehicle is properly in favour of the Shandi Trust and that the vehicle will only be used in terms of the restrictions of such insurance policy.’

City Press understands that SARS has a concurrent claim against Mkhize in her personal capacity for R12m.
