Modack focuses on Kinnear’s alleged link to gang boss
Nafiz Modack says he commissioned Zane Kilian to ping Charl Kinnear to prove the late Anti-Gang Unit detective was visiting alleged 26s and Sexy Boys gang boss Jerome Booysen.
And, he said, Kilian's pinging confirmed his suspicions, reports News24.
Modack's defence to the charge of murdering Kinnear on 18 September 2020 was crooked police officers were out to get him when he started removing drugs from clubs whose security he had taken over.
He said he was a cardholding member of the Debt Collectors' Association, and pinged to trace yachts, vehicles, and trucks for banks and a client. Modack added he thought it was legal because cellphone providers facilitated it, and such big companies would not do anything unlawful.
He claimed at the start of the trial in the Western Cape High Court, Kinnear was also a compromised police officer, and he was about to come clean.
To silence him, somebody else killed him, not Modack.
To support this point, Modack's counsel, Advocate Bash Sibda, pointed to entries on the state's pinging evidence. This was obtained from former police officer Bradley Goldblatt who ran the illegal cellphone location tracking platform.
Sibda said the ping data on Kinnear and Booysen matched three times.
But, according to News24, investigating officer Captain Eddie du Plessis rebuffed this by providing his interpretation of the 2 408 pings to Kinnear's main phone and the 193 to Booysen's phone, allegedly by Kilian.
Modack, Kilian and 13 others, who are allegedly part of a criminal enterprise that conspired to murder Kinnear and others, have all pleaded not guilty to all the charges.
Modack claimed all the permutations of his name saved on WhatsApps retrieved from a folder Kilian did not delete when he cleared his phone on arrest, were fake.
He said this was a bid to throw doubt on WhatsApp screengrabs of texts to and from Modack found on Kilian's phone.
Sibda also suggested Kilian created fake Modack profiles then took screengrabs of the ‘conversation’ with Modack for clout.
Last week, Modack claimed he had a photo of Kinnear and Booysen at Booysen's home.
Booysen is on trial with Mark Lifman, Andre Naude and others for the murder of Brian Wainstein and violent incidents linked to a nightclub security battle, after Modack allegedly muscled in on their turf.
Booysen also faces a drugs trial next year.
