Malema's R1m suit against Kunene struck off
A R1m lawsuit EFF leader Julius Malema launched against Patriotic Alliance deputy president Kenny Kunene was struck from the roll of the Gauteng High Court (Johannesburg) yesterday.
This after a document which was filed on time on central online legal document platform CaseLines came through late due to an administrative error, according to Judge Leonard Twala.
A step to load the document onto the platform, where the judge could have sight of it, was not done until Monday night.
Malema’s team will pay Kunene’s legal team’s costs.
Malema wants Kunene to pay him damages for defamation in connection with the PA deputy president’s claim on a MacG podcast in February this year that he was linked to alleged ‘Big Five’ cartel leader, Jothan Msibi.
Malema vehemently denies those accusations and disputes the testimony of Msibi’s alleged chef, who claims he witnessed the EFF leader give the taxi kingpin expensive whiskey and cash.
The limited WhatsApp evidence that Nyatlo has already exposed also suggests Malema may be implicated in tender rigging, reports News24.
Kunene said Malema has no grounds to sue others for making statements about him, arguing that the EFF leader frequently makes similar remarks about other people, reports EWN.
‘He behaves like a primary school child, who bullies all the children until one slaps him, then he runs to the principal’s office.’
Malema’s legal team is seeking to have the matter reinstated, maintaining that it was struck off the roll due to procedural shortcomings rather than the merits of the case.
