The estate of late former SAA chairperson Dudu Myeni has been placed under provisional sequestration by the KZN High Court (Pietermaritzburg).

News24 reports that the order was granted on 14 August, and reasons were provided this week. A hearing has been set for 6 November to determine whether the order should be made final.

The provisional order followed an application by the Organisation Undoing Tax Abuse (Outa), which has court-awarded legal costs of R6.1m against Myeni’s estate, which stem from litigation in which Myeni was declared a delinquent director under the Companies Act.

Myeni died on 14 June 2024 while the sequestration proceedings against her were already underway.

Judge Namhla Siwendu held that sequestration proceedings initiated during a person’s lifetime may continue against their estate after death, and that the administration of an estate under the Administration of Estates Act does not shield it from insolvency proceedings under the Insolvency Act.

The urgency in the case stemmed from the publication of a liquidation and distribution account in September 2025.

The account showed immovable property valued at around R4.9m, a R3m loan secured against it, and a distributable balance of approximately R1 791 229.90, earmarked for Myeni’s three children – about R597 000 each.

However, Outa’s R6.1m claim appeared nowhere in that account.

The executrix of the estate, one of the named beneficiaries – Thandeka Ngwenya – opposed the sequestration application, arguing that the estate should be administered under ordinary estate procedures and that Outa had forfeited its rights by failing to lodge its claim within the prescribed time.

Siwendu rejected those arguments, saying it would be incongruous to hold that Outa’s right to pursue the pending sequestration proceedings was extinguished merely because it did not participate in the procedure contemplated by the Administration of Estates Act.
