Anneke Elize Whelan

Anneke has over twenty years post admission experience in Commercial Litigation and is the lead commercial litigation attorney in Shepstone and Wylie's Cape Town office. Anneke deals daily with High Court litigation and arbitration work and has extensive experience in motion court work including the bringing and opposing of urgent interdict applications, sequestration, liquidation and business rescue applications. She has many years experience in insolvency inquiries and post insolvency litigation as well as the interpretation, management and arbitration relating to construction contracts and related agreements in the construction industry. A further area of expertise is the medical aid industry where Anneke over the last 10 years advised medical aid schemes on various issues. Anneke was recently appointed as the Independent Electoral Body to oversee and manage the election of a new board of trustees of one of the country's largest open medical schemes. She was admitted to appear in the High Court of South Africa in 1996 and has successfully represented clients in the High Court in disputes relating the rectification of shareholders' register, enforceability of foreign debts and the competence of international jurisdiction, attachment of assets to found jurisdiction, the liability of members where the close corporation had been liquidated, the freezing of bank accounts and other assets, the nature of maritime claims and ship casualty work. She also represents international ship owners in London Maritime Arbitration proceedings. Anneke has published in the Financial Mail on issues relating to the Business Rescue provisions under the new Companies Act and in the IBA Maritime Committee newsletter on the nature of maritime claims in South Africa. Service on Boards and Associations: Anneke is a member of the steering committee of the Arbitration Foundation of South Africa. She is also a member of the Maritime Law Association and the South African Restructuring and Insolvency Practitioners Association and sits on the board of Cape Town Community Housing Corporation (Pty) Limited and as trustee of the Keiskamma Trust. Anneke was appointed as an instructor by L.E.A.D. where she teaches High Court practice to candidate attorneys.
