Ayanda Nondwana focuses on commercial and insurance litigation with a special emphasis on directors’ and officers' liability, professional indemnity claims, personal injury claims, product liability and general public liability litigation. He has right of appearance in the High Court and predominantly makes his own appearance and drafts pleadings and notices independent of counsel. Acting for the Road Accident Fund in some of its larger personal injury matters, he is accustomed in producing the most favourable outcome. Ayanda prepared a guide on the implications of the new Companies Act as it relates to directors’ and officers’ liability. Representative experience: Representing a small cap insurer in a contentious transfer of business dispute with a top insurer in terms of the Long Term Insurance Act. Advised a state-owned company in a policy coverage dispute with regard to a fidelity guarantee insurance policy wherein the insurer rejected a ZAR18m claim. Representing the Attorneys Insurance Indemnity Fund in defending various legal actions instituted against attorneys for professional negligence relating to conveyancing, prescription, contractual and under-settlement matters. Representing and advising a state-owned entity in recovering ZAR18m as a result of fraud committed by a former executive in collusion with a supplier. Advised an organ of state on the adjudication of a tender with the value of ZAR1bn. Successfully investigating three fraudulent loss of support claims instituted against the Road Accident Fund totalling ZAR1.5m. Negotiated a favourable settlement of a ZAR40m claim for damages and loss of income against the Road Accident Fund, saving the client ZAR37.5m plus costs.
